Members present:  Chair Pam Kueber, PK; Ned Douglas, (ND); Ethan Berg, (EB); Robert Fuster, RF; Sue Lyman, SL Continued from March 3, 2009.
Staff present:  Peggy Ammendola, PA

Also present was Building Inspector Bill Thornton.

Margaret McTeigue, owner of the property and her contractor, Dan Satori were present.

There were no abutters present.

PK said that since the last meeting, she has spoken to Assistant Building Inspector Don Fitzgerald to address the Board’s concerns relative to this petition.  She stated that a dwelling unit is defined as one in which there are bedrooms, but does not necessarily have a kitchen.  It is subject to the Building Code’s safety standards.  With respect to this petition, the upper floor of this structure, with access to the lower unit, can be identified as the Accessory Dwelling Unit.  The decision can be written to include that the lower level cannot be used as part of the dwelling unit.

Bill Thornton said that this unit will have cooking facilities, but not a kitchen.  The Certificate of Occupancy will be issued only for the dwelling unit.

Dan Satori said that the upper level is approximately 775 square feet.

ND made a motion to close the public hearing and EB seconded the motion.  The Board voted to agree to close the public hearing 5-0.

EB made a motion to approve the Special Permit under Sections 3.3.3 and 7.2.1 to allow an accessory dwelling unit and ND seconded the motion.   The Board voted 5-0 to agree.
